Summary
Biostimulants, soil improvers and fertilisers are regulated by various pieces of legislation in Denmark.
Certain types of products do not need to be registered for sale. These include livestock manure, sewage sludge and degassed biomass.
Product types that need to be registered are, i.a. organic fertilisers, compost and microbial biostimulants. After the product has been registered, it will be on a list that is regularily updated by the Danish authorities. Also, the identify of the seller/distributor in Denmark needs to be communicated to the authorities.
This company or individual must have a registered address in Denmark.
The Executive Order on Fertilisers and Soil improvers BEK no 1135 of 09/07/2022 is a regulation concerning fertilizer products, including biostimulants and soil improvers, specifically addressing the requirements and standards for these products in Denmark. Overall, this piece of legislation aims at ensuring that these products meet specific quality, labeling, and safety standards to facilitate their effective and safe use in agriculture and horticulture.
To qualify whether a product is a biostimulant, it (1) must not be categorized under the scope of plant protection products as defined by relevant EU regulations, (2) it should have a specific intended effect on plant nutrient processes or other characteristics listed above, rather than supplying nutrients directly and (3) it should be labeled according to the requirements for biostimulants, including listing its active ingredients and intended use effects. Biostimulants are defined by their intended effects and functions.
These criteria help differentiate biostimulants from fertilizers and plant protection products by focusing on their functional role in enhancing plant growth and development processes rather than directly providing nutrients or protecting plants from pests and diseases.
The Act amending the Chemicals Act, the Environmental Protection Act and the Fertilizers and Soil Improvers Act, etc LAW No. 2214 of 29/12/2020 outlines amendments to various Danish laws concerning chemicals, environmental protection, and regulations related to fertilizers and soil improvers. The amendments involve the addition of provisions that allow for the enforcement of compliance with laws concerning soil improvers.
The Proclamation of the Act on Fertilizers and Soil Improvers, etc LBK no. 16 of 04/01/2017 regulates fertilisers and products designed to enhance plant growth, including biostimulants and soil improvers. The legislation emphasizes the need for products to be safe for public health and the environment, necessitating documentation of their effects and compliance with established safety standards. Detailed provisions for monitoring, enforcement, and potential sanctions for non-compliance are included, empowering the ministry to conduct inspections and impose penalties where necessary.
Data requirements to be completed for every product registration comprise (but are not limited to) N, P and K contents, the seller's name and address, country and place of production, dry matter, organic matter, Calcium, Magnesium, Sodium, Sulfur, Boron, Cobalt, Iron, Manganese, Molybdenum, Zinc total contents, the product label in Danish and the MSDS in Danish.
The fee to be paid to the authorities for a registration is 1147 DK plus an annual fee of 1147 DK, plus a smaller amount to be paid per quantity sold.
The waiting time to receive a registration is about 1-4 weeks, according to authority sources.
